Six document and rights checks before the CPCV

1. Certidao Permanente do Registo Predial: verify ownership, mortgages, attachments, charges and pending registrations. 2. Caderneta Predial Urbana: compare tax identification, areas and taxable value with title and the building; tax registration does not prove planning legality.

3. Licenca de Utilizacao and DL 10/2024 Simplex urbanistico: the removal of a document-production requirement at transfer does not legalize unauthorized construction. Check applicable permits, exemptions and municipal records. 4. Ficha Tecnica de Habitacao: request available technical documentation and confirm applicability; Simplex removed the former requirement to present the technical sheet at transfer.

5. Condominium debt clearance under Law 8/2022: request the administrator declaration of charges and debts. A buyer waiver can transfer responsibility for seller debts, so do not waive it without advice. 6. Direito de Preferencia: establish whether municipal or other statutory pre-emption rights apply and complete required notices before the deed. These are essential due-diligence checks, not six universally mandatory documents for every building.

Protective CPCV clauses

Ask your independent Ordem dos Advogados lawyer to draft a structural-survey condition precedent with objective acceptance criteria and a refund mechanism, a mortgage-approval contingency with deadline and evidence requirements, and clear title and tax-clearance warranties.

Specify completion dates, agreed fixtures, vacant possession, remedies, deposit handling and outstanding licensing actions. Clauses must fit the property and transaction; a generic template does not establish your rights.

Independent representation and transparent fees

Choose a lawyer who represents your interests and discloses conflicts with the seller, agent and developer. Verify Ordem dos Advogados registration and professional insurance.

Compare written fixed-fee scopes against percentage fees. Confirm whether negotiations, document checks, CPCV drafting, deed attendance, tax support and post-deed registration are included. Tax and registry costs should remain separate line items.

Buyer questions

How much does a property lawyer cost in Portugal?

For a EUR 300k-500k purchase, the supplied fixed-fee reference is EUR 2,100 - EUR 3,500 before IVA. Complexity, representation and disbursements can change the quote.

Is a 1% to 1.5% legal fee mandatory?

No. It is a comparison model, not a statutory tariff. Request a written fee agreement with a clear scope and compare fixed-fee proposals.

Does Simplex remove the need to check the habitation licence?

No. Changes to document presentation at transfer do not prove lawful construction or approved use. Have your lawyer check the applicable licensing records.

Can I waive the condominium debt certificate?

A waiver can make you responsible for seller debts. Obtain independent advice before waiving the administrator declaration required by the applicable rules.

What stamp duty should I budget for?

The standard acquisition rate is 0.8% of the applicable taxable value, generally the higher of price and taxable property value. Personal eligibility relief may change the amount.

Which CPCV conditions protect an expat buyer?

Discuss a satisfactory structural survey, mortgage approval, clear title and tax clearance, with explicit deadlines and refund consequences tailored by your independent lawyer.
